What is a Domestic Relations Order or DRO?
A Qualified Domestic Relations Order (QDRO) is a court order used in many Illinois divorce cases to divide certain retirement benefits between spouses. While a divorce judgment may award one spouse a portion of the other's retirement account, a QDRO is often required to allow the retirement plan administrator to legally divide and distribute those benefits.
QDROs commonly apply to employer-sponsored retirement plans, such as 401(k)s, pensions, and other qualified retirement plans. Without a properly drafted and approved QDRO, the retirement plan cannot distribute benefits according to the divorce judgment, which can lead to delays and unintended financial consequences.
Preparing a QDRO requires careful attention to both federal law and the specific requirements of the retirement plan. Even small drafting errors can create costly problems or affect the division of retirement assets.
If retirement accounts are part of your divorce, it is important to ensure that all necessary documents are prepared correctly and submitted promptly. At Kreke Smith, LLC, we help clients navigate every aspect of property division, including the preparation and implementation of Qualified Domestic Relations Orders, to protect their financial interests both now and in the future.
